Kurzfassung

Ziel dieser Diplomarbeit ist es, den Begriffsinhalt und den Umfang der Ausscheidung von unterpreisigen Angeboten und Angeboten mit nicht plausiblem Gesamtpreis aus betriebswirtschaftlicher Sicht zu betrachten. Im Zuge der Arbeit soll auf die vertiefte Angebotsprüfung eingegangen, und die Bestimmungen des österreichischen Bundesvergabegesetzes mit denen in anderen europäischen Ländern verglichen werden. Auch die Konformität der dargestellten Verdingungsordnungen mit dem europäischen Recht ist zu überprüfen.
Im ersten Teil der Arbeit wird ein allgemeiner Einblick in die wesentlichen Neuerungen des Bundesvergabegesetzes 2002 sowie in den Ablauf und die Grundsätze eines Vergabeverfahrens gegeben.

Abstract The elimination of tenders for business economic reasons according to the Bundesvergabegesetz 2002

This master's thesis examines the definition and magnitude of the elimination of abnormally low tenders and tenders with implausible all-round-price, as it is used for business economic reasons. In the course of the thesis, the attention is drawn on the deepened tender vetting
and the regulations of the austrian BVergG shall be compared to those in other european countries. Also the conformity of the illustrated contracting rules with the european law shall be examined.
The first chapters deliver a general insight of the essential improvements of the BVergG 2002 as well as the course and principles of the award procedure.
Afterwards the study lays out the basic message, which is the detailled analysis of the tender vetting, the price check and deepened tender vetting and the elimination of tenders.
Based on the carried out study, a comparison with the contracting rules of some other european countries is made and the conformity of the layed out foreign and domestic regulations referable to the european public procurement law is examined.
